Shared parenthood after separation

The two women married in the United States and each gave birth following assisted reproduction using eggs from one partner. The other partner carried their daughter and helped raise both children. Their separation led to a dispute over care and contact. Reuters’ 2020 reporting explored the resulting questions about parenthood. Reuters (via Investing.com)

The parties are referred to here as the claimant and her former partner. Children’s names, birth dates and locations are omitted. Reports use different names or aliases; the procedural history provides the basis for matching the accounts.

From Zhejiang’s Zhoushan to Beijing’s Fengtai District

The Beijing News reported on 27 April 2020 that Dinghai District People’s Court in Zhoushan had accepted the case on 1 April. Gao explained that proceedings began there because the defendant’s household registration was in Zhoushan. The defendant challenged jurisdiction based on residence and work in Beijing. The Paper subsequently reported that Gao submitted written objections to transfer. On 26 May 2020, the claimant received notice that the case would move to Beijing, bringing the initial Zhoushan proceedings into a new procedural stage. The Paper · feature

Mingyue Gao’s role as counsel

The Beijing News, Sixth Tone and AP identify Gao as the claimant’s lawyer. Sixth Tone’s May 2020 account describes her search for legal assistance and the difficulties faced by same-sex parents seeking to maintain contact after separation. Sixth Tone

In The Paper’s June 2020 interview, Gao highlighted choice of law: how should overseas family formation and foreign elements inform guardianship and custody proceedings in China? He advocated considering law favourable to the children, shared parenting intentions, established care and continued relationships with both caregivers. These were counsel’s arguments, not findings attributed to a court. The Paper · counsel interview (via Sohu)

The 2024 reporting: visitation and implementation

AP reported in August 2024 that the Beijing case reached a settlement providing contact with the daughter the claimant had carried. It also reported difficulties implementing visitation afterwards. Securing an arrangement and putting it into practice were distinct stages. Associated Press (published by The Independent)

The reporting does not establish nationwide recognition of same-sex marriage, a general two-mother rule, or an award of custody of both children to the claimant. Full court, settlement and enforcement documents were not available in this research; those documents govern the precise outcome.

Three questions the case brings into focus

Legal parentage, day-to-day care and ongoing contact are related but distinct questions. Genetics, gestation and lived parenting each raise different issues. A transfer of jurisdiction affects not only venue but potentially the duration of parent-child separation.

This feature’s assessment is that the case illustrates the work of seeking practical arrangements for children within complex family structures. Public accounts of filing, legal argument and implementation show several dimensions of family-law representation.

Reporting in China and internationally

Coverage spans initial proceedings in 2020 and follow-up reporting in 2024. The index distinguishes originating outlets from syndication platforms. The Paper’s two articles are from one outlet; republication of an AP dispatch does not constitute a separate interview.
